Social Security Disability FAQ
Social Security Disability (SSDI)
When a serious physical or mental health condition prevents you from working, Social Security Disability Insurance (SSDI) may provide the support you need. However, the process is often confusing, frustrating, and slow.
At Davis Disability Group, the attorneys are dedicated to guide clients through every step of the disability process, from answering questions about filing the initial application to representing you at hearings. You will receive compassionate and skilled representation as you navigate this legal process.
Work History is required for SSDI
SSDI benefits are funded by the Social Security taxes you pay on income from employment or self-employment. As you work, you earn “work credits”, which are calculated based on your yearly earnings. You can earn up to four work credits per year.
The number of credits you need to qualify for SSDI depends on the age at which you became disabled. An older individual generally needs more credits than younger workers. During a free consultation, an attorney at Davis Disability Group can review your work history and determine whether you meet the requirements for SSDI benefits.
Disability is required for SSDI
Even if you have enough work credits, you must also meet Social Security’s definition of a disability. For SSDI, this means you have a medically documented physical or mental condition that prevents you from engaging in substantial gainful activity.
SSDI requires that your condition has lasted or is expected to last at least 12 continuous months, or is expected to result in death. The 12 month period must be continuous.
Meeting these disability requirements is challenging. For example, if you are still able to perform the work you did before the onset of your disability, Social Security will deny your claim. Your claim may also be denied if the medical evidence shows that you could adjust to other work, even if you have never done that type of job before.
As stated before, the attorneys and staff at Davis Disability Group are here to help you through this legal process and are committed to achieving a positive result in your case.
